This Agreement sets forth your rights and obligations as a Mukwa Safety Services Inc User. By clicking “I Agree,” You indicate that you have read and understood this agreement and you will be bound by its terms.
IMPORTANT – PLEASE CAREFULLY READ AND UNDERSTAND THESE TERMS AND CONDITIONS OF USE & SALE BEFORE ACCESSING, USING, CREATING YOUR USER ACCOUNT OR SUBSCRIBING OR PLACING AN ORDER OVER Mukwasafety.com THESE TERMS CONTAIN DISCLAIMERS OF WARRANTIES AND LIMITATIONS OF LIABILITIES (see Sections 10 and 11). THESE TERMS FORM AN ESSENTIAL BASIS OF OUR AGREEMENT.
The use of Mukwasafety.com (hereafter “Website”), which is owned and maintained by Mukwa Safety Services Inc (“Mukwa Safety” "Mukwa" “we,” “our,” “us”), is governed by the terms and conditions set forth below. We offer the Website, including all information, tools, the sale of personal protective equipment (“PPE”) and related safety products and or services available from the Website to you, the user, conditioned upon your acceptance of all terms and conditions stated here. By accessing, using, subscribing, placing an order over the Website, or accepting delivery of goods you and your business agree to the terms set forth herein. If you do not agree to these terms and conditions in their entirety, you are not authorized to use the Website in any manner or form whatsoever.
THIS IS A BINDING AGREEMENT. THESE TERMS AND CONDITIONS OF USE & SALE (“TERMS”) TOGETHER WITH OUR PRIVACY STATEMENT FORM A LEGALLY BINDING AGREEMENT (“AGREEMENT”) BETWEEN YOU AND YOUR BUSINESS (“YOU”) AND Mukwa Safety Services Inc THIS AGREEMENT GOVERNS YOUR ACCESS TO AND USE OF THE WEBSITE AND THE SERVICES PROVIDED BY Mukwa Services Inc ANY ORDER YOU PLACE THROUGH THE WEBSITE, BY TELEPHONE, OR OTHER ACCEPTED METHOD OF PURCHASE AND, AS APPLICABLE, YOUR USE OR ATTEMPTED USE OF THE PRODUCTS OR SERVICES OFFERED ON OR AVAILABLE THROUGH THE WEBSITE.

Mukwa operates as a supplier of industrial safety products PPE and services to commercial, industrial, institutional, and government clients.
2. APPLICABLE LAW AND REGULATORY FRAMEWORK
These Terms are governed by and shall be interpreted in accordance with:
The Consumer Protection Act, 2002 (Ontario)
The Sale of Goods Act (Ontario)
The Occupational Health and Safety Act (Ontario)
The Personal Information Protection and Electronic Documents Act (PIPEDA)
Canada’s Anti-Spam Legislation (CASL)
Regulatory oversight may include:
The Office of the Privacy Commissioner of Canada
The Ontario Ministry of Public and Business Service Delivery
Workplace safety authorities, where applicable
Nothing in these Terms excludes or limits statutory rights that cannot legally be waived.
3. WEBSITE USE AND ACCEPTABLE CONDUCT
Users agree to:
Use the website only for lawful commercial purposes
Provide accurate information when placing orders
Not engage in fraudulent transactions
Not interfere with website functionality or security
Prohibited conduct includes:
Attempting unauthorized access to servers or data
Scraping pricing or product data for resale
Uploading malicious code
Misrepresenting identity
We reserve the right to suspend or terminate access where misuse is suspected.
4. PRODUCT INFORMATION AND REGULATORY COMPLIANCE
Mukwa supplies products that may be subject to:
CSA standards
Manufacturer certification requirements
Workplace regulatory standards
Industry-specific procurement conditions (e.g., infrastructure, utilities, nuclear)
Customers are solely responsible for:
Ensuring product suitability
Verifying compliance with workplace requirements
Confirming sizing and technical specifications
Product images, certifications, and descriptions are provided for guidance and may change based on manufacturer updates.
5. ACCOUNT REGISTRATION AND CREDIT TERMS
Commercial customers may apply for credit accounts subject to approval.
By opening an account, you authorize Mukwa to:
Verify credit references
Conduct lawful credit checks
Establish credit limits
Payment terms may include:
Net 15 / Net 30
Prepayment
Credit card
EFT
Late payments may incur interest charges permitted under Ontario law and administrative collection costs.
Accounts in arrears may be suspended without notice.
6. ORDER ACCEPTANCE AND CONTRACT FORMATION
All orders are subject to review and acceptance.
A binding contract is formed only when:
Mukwa issues written order confirmation; or
Goods are shipped.
We reserve the right to:
Cancel orders due to pricing errors
Adjust pricing due to supplier changes
Refuse orders deemed high risk
7. PRICING, TAXES, AND CURRENCY
All prices are in Canadian Dollars (CAD) unless stated otherwise.
HST and applicable provincial taxes will be applied.
Pricing is subject to change without notice.
In the event of typographical or system pricing errors, Mukwa may cancel or adjust affected orders prior to shipment.
8. SHIPPING, DELIVERY, AND RISK
Delivery timelines are estimates only and not guaranteed.
Risk of loss transfers to the customer when:
Goods are delivered to carrier; or
Customer or agent accepts possession.
Customers must inspect shipments immediately and report visible damage within 5 business days.
Mukwa is not responsible for:
Carrier delays
Customs delays
Supply chain disruptions
9. RETURNS AND RESTOCKING
Returns are governed by Mukwa’s Return Policy.
Due to hygiene and regulatory safety requirements:
Most PPE items are non-returnable once opened
Restocking fees up to 25% may apply
RMAs are mandatory
Contract or institutional orders may override standard return conditions.
10. WARRANTIES
Except as required by the Sale of Goods Act:
Products are sold “as is” subject to manufacturer warranty
Mukwa disclaims implied warranties beyond statutory minimums
Warranty claims may require direct manufacturer coordination
Mukwa does not warrant:
Fitness for a particular workplace unless expressly agreed in writing
Compatibility with non-specified equipment
11. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
Mukwa is not liable for indirect, incidental, special, or consequential damages
Liability is limited to the purchase price of the goods
Mukwa is not responsible for workplace enforcement actions
This does not exclude liability where prohibited by statute.
12. INDEMNIFICATION
Customers agree to indemnify Mukwa from claims arising from:
Improper use of PPE
Failure to comply with workplace regulations
Product misuse or alteration
Third-party injury resulting from customer negligence
13. PRIVACY AND PERSONAL INFORMATION
Mukwa collects personal information consistent with PIPEDA.
Information collected may include:
Names
Business contact information
Billing details
Transaction history
IP address and device identifiers
Information is used for:
Order processing
Account management
Fraud prevention
Regulatory compliance
Marketing communications (with consent)
Personal data is stored securely and retained only as long as necessary for business and legal purposes.
Individuals may request:
Access to their data
Correction of inaccurate information
Withdrawal of consent (subject to legal limits)
We do not sell personal information.
14. ELECTRONIC COMMUNICATIONS AND SMS CONSENT (CASL COMPLIANCE)
Where customers provide consent, Mukwa may send:

Written or electronic authorization
In accordance with CASL:
Customers may withdraw consent at any time

16. INTELLECTUAL PROPERTY
Ownership Clause:
All logos, website domain (and it's linked emails), social media accounts, copyrights and or trademarks, branding, written copy, toll-free numbers, website design and its elements (collectively, 'Licensed IP') displayed on this site are the exclusive property of Kristine VanAlstyne. Mukwa Safety Services Inc uses these assets under a limited, non-exclusive licence agreement.
Usage Restrictions:
Nothing contained on this website should be construed as granting, by implication or otherwise, any licence or right to use any Licensed IP without the express written permission of Kristine VanAlstyne.
Reservation of Rights:
Kristine VanAlstyne reserves all rights in and to the Licensed IP not expressly granted to Mukwa Safety Services Inc under the licence agreement.
Unauthorized reproduction, distribution, or commercial use of any logo, copy or brand identifier is strictly prohibited.
17. FORCE MAJEURE
Mukwa is not liable for failure to perform obligations due to events beyond reasonable control, including:
Natural disasters
Supply chain interruptions
Government regulation
Labour disputes
Transportation failures
18. DISPUTE RESOLUTION
These Terms are governed by the laws of Ontario and Canada.
Disputes shall be resolved exclusively in Ontario courts unless otherwise agreed in writing.
19. SEVERABILITY
If any provision of these Terms is found invalid or unenforceable, remaining provisions remain in full force and effect.
20. MODIFICATION OF TERMS
Mukwa may update these Terms at any time.
The version posted on the website at the time of transaction governs.
